Welcome to the Nurturely CRM Affiliate Program (the "Program"). By participating in the Program, you agree to be bound by these Terms and Conditions (the "Terms"). Please read them carefully. If you do not agree to these Terms, you may not participate in the Program.

OVERVIEW

The Nurturely CRM Affiliate Program allows individuals or entities ("Affiliates," "you," or "your") to earn commissions by referring new customers to Nurturely CRM ("we," "us," or "our") through unique affiliate links. Affiliates earn a 15% recurring commission on the subscription fees paid by customers they refer, subject to the terms outlined below.

ELIGIBILITY

To participate in the Program, you must be at least 18 years old and have the legal capacity to enter into binding agreements. Affiliates may be individuals, businesses, or organizations, provided they comply with these Terms. We reserve the right to approve or reject any affiliate application at our sole discretion.

ENROLLMENT

To join the Program, you must complete the affiliate application process and be approved by Nurturely CRM. Upon approval, you will receive a unique affiliate link (the "Affiliate Link") to track your referrals. You are responsible for ensuring that your contact and payment information remains accurate and up-to-date at all times.

COMMISSION STRUCTURE

Commission Rate. Affiliates earn a 15% recurring commission on the net subscription fees (excluding taxes, refunds, and discounts) paid by each referred customer (a "Referred Customer") who signs up for a paid Nurturely CRM subscription using your Affiliate Link.

Payment Timing. Commissions are paid out at the end of a 60-day period following the Referred Customer's initial subscription sign-up date, provided that the Referred Customer remains an active subscriber and that payment has been successfully received by Nurturely CRM.

Unlimited Referrals. There is no limit to the number of Referred Customers you may refer or the commissions you may earn, as long as all referrals comply with these Terms.

PAYMENT TERMS

Commissions are paid via [insert payment method, e.g., PayPal, bank transfer] to the account you designate during enrollment. Payments are processed monthly, with a minimum payout threshold of [insert amount, e.g., $50]. If your earned commissions do not meet the threshold in a given cycle, they will roll over to the next payment cycle. You are responsible for any taxes, fees, or costs associated with receiving commission payments.

REFERRAL TRACKING

Commissions are tracked through your unique Affiliate Link. You will only earn commissions for Referred Customers who sign up directly through your Affiliate Link. Nurturely CRM is not responsible for lost commissions due to improper use of the Affiliate Link, technical issues beyond our control, or fraudulent activity.

AFFILIATE RESPONSIBILITIES

Promotion. You may promote Nurturely CRM through lawful and ethical means, including websites, blogs, social media, email marketing, and other channels, provided they comply with these Terms.

Prohibited Actions. You may not:

a. Use spam, unsolicited emails, or any illegal marketing methods to promote Nurturely CRM.

b. Misrepresent Nurturely CRM's services, pricing, or features.

c. Bid on Nurturely CRM-branded keywords in paid advertising campaigns (e.g., Google Ads) or use our trademarks in a way that suggests you are an official representative of Nurturely CRM.

d. Refer yourself, your own accounts, or entities you control for the purpose of earning commissions.

Content Guidelines. All promotional materials must be accurate, professional, and compliant with applicable laws and regulations.

TERMINATION

By You. You may terminate your participation in the Program at any time by notifying us in writing.

By Us. We may terminate your participation in the Program at our sole discretion, with or without cause, including but not limited to violations of these Terms, fraudulent activity, or damage to our reputation.

Effect of Termination. Upon termination, you will receive payment for any earned commissions up to the termination date, provided that they meet the payout threshold and comply with these Terms.

REFUNDS AND CHARGEBACKS

If a Referred Customer cancels their subscription or receives a refund within the first 60 days, no commission will be paid for that customer. If a commission has already been paid and a refund or chargeback subsequently occurs, we reserve the right to deduct the corresponding amount from your future commission payments.

INTELLECTUAL PROPERTY

We grant you a non-exclusive, revocable license to use approved marketing materials and our trademarks solely for the purpose of promoting Nurturely CRM under this Program. You may not alter, modify, or create derivative works of our intellectual property without our prior written consent.

LIMITATION OF LIABILITY

Nurturely CRM shall not be liable for any indirect, incidental, or consequential damages arising from your participation in the Program. Our total liability under these Terms shall not exceed the total commissions paid to you in the preceding 12 months.

MODIFICATIONS

We reserve the right to modify these Terms at any time. Changes will be communicated to you via email or through the affiliate portal. Your continued participation in the Program after such changes constitutes acceptance of the updated Terms.

GOVERNING LAW

These Terms are governed by the laws of [insert jurisdiction, e.g., the State of California, USA], without regard to its conflict of law principles.
